Data protection is a matter of trust, and your trust is important to us. In order for you to feel safe when you visit our websites, we strictly observe the legal provisions upon processing your personal data, and here would like to inform you about our data collection and use of data. The following privacy statement explains, which of your data is collected on our websites and which of this data we process and use in which manner, and whom you can contact with concerns about that.

We would like to point out that data transmission on the Internet (e.g. upon communication via E-mail) may have security gaps. Complete protection of data from third-party access is not possible.

1. Objective and entity in charge
This privacy statement explains about type, scope and purpose of processing (collection, processing and usage as well as obtainment of consents, among other things) of personal data within our online offer and the associated websites, functions and contents (hereinafter jointly referred to as “online offer” or “website”). The privacy statement shall apply independent of the domains, systems, platforms and devices used (e.g. desktop or mobile), on which the online offer is executed.

The entity in charge of collection, processing and usage of your personal data in terms of the Federal Data Protection Act is Eyeworks GmbH (hereinafter: Eyeworks). You can reach Eyeworks as the entity in charge using the contact data stated in the following:

The term "user" shall comprise all customers and visitors of our online offer. The terminology used, as e.g. "user" is to be understood as gender-neutral.
 

2. Basic information on data processing
We only process personal data of users in compliance with the relevant data protection regulations according to the principles of data economy and data avoidance. This means, that data of users is only processed with a legal permission present, in particular when the data is required for rendering our contractual services as well as online services or is legally required, resp., or with respective consents present.

We take organisational, contractual and technical security measures according to the state of the art in order to ensure that the regulations of the data protection laws are complied with and in order to thus protect the data processed by us against accidental or intentional manipulations, loss, destruction, or against access by unauthorised persons.

If within the scope of this privacy statement, contents, tools, or other means of other providers (hereinafter jointly referred to as “third-party providers”) are used and their domicile is located abroad, then it must be assumed that there is data transfer to the countries of domicile of the third-party providers. The transmission of data to third countries takes place either on the basis of a legal permission, consent of the users or special contractual clauses, guaranteeing legally specified security of the data.

 

3. Processing of personal data
Beside the uses expressly stated in this privacy statement, personal data is processed for the following purposes on the basis of legal permissions or consents of the users:

– provision, execution, maintenance, optimisation and securing of our services, service performance and user services;
– guaranteeing effective customer services and technical support.

We only transmit data of users to third parties, if this is necessary for billing purposes (e.g. to a payment service provider) or for other purposes, if these are necessary to fulfil our contractual obligations towards the users (e.g. communication of an address to suppliers).
Upon contacting us (via contact form or E-mail), the user details are saved for the purpose of processing the request as well as for the case that follow-up questions arise. Personal data is deleted as soon as it has fulfilled its purpose and deletion is not opposed by retention requirements.

 

4. Collection of access data
We collect data about any access to the server, on which this service is located (so-called server log files). The access data includes the name of the website retrieved, file, date and time of retrieval, data volume transferred, notification about successful retrieval, type of browser, incl. version, operating system of the user, referrer URL (the page visited before), IP address, and the enquiring provider.
We use protocol data according to the legal provisions only for statistical analyses for the purpose of operation, security and optimisation of our online offer, without allocation to the identity of the user or other profile generation. However, we reserve the right to subsequently check the protocol data, if, due to concrete indications, there is justified suspicion of illegal usage.

5. Credit assessment
Prior to concluding the purchase contract, we perform a credit assessment. This is undertaken in order to be able to offer you a choice of various payment methods. Simultaneously, the credit check serves protecting us against payment defaults. In addition, the credit assessment serves your and our security, since hereby, fraud and other offences are prevented. Within the scope of the credit assessment, we check all data available to us and thus determine, which payment methods can be offered for an order. In that, among other things, all preceding orders in your user account are checked. In addition, it is likewise checked, whether the delivery address differs from the billing address, whether it is a new delivery address, or whether the order is to be delivered to a Packstation (parcel pick up station). Beside the data we have present, data of external service providers are likewise required. For that, we transmit the personal data required for a credit assessment (for B2C customers first and family name, address as well as date of birth, if applicable, and for B2B customers company name, company register number, address as well as VAT number) to the following credit assessment service provider:

This credit assessment service provider uses the above stated data transmitted by us to undertake, on the basis of mathematical-statistical methods, a respective assessment of the credit rating with regard to the respective order (scoring). Furthermore, the credit assessment service provider uses the data stated above for other companies (e.g. other online retailers) for the purpose of address verification or identity verification, resp., as well as for scoring applications based thereon. Address data is also included into the calculation of the probability value. In that, a conclusion of hard negative indicators might be possible. Should you not agree with the payment method(s) offered, you may send a notification to the contact stated under Item 1. We will then check the decision again, considering your point of view. You can revoke your consent to us anytime with effect for the future by sending a notification to the contact stated under Item 1 as well as obtain information about the stored data from us and from our credit assessment service provider (under the addresses stated above).

In order to be able to offer you Klarna's payment options, we will transmit personal data, such as contact data and order data, to Klarna. In this way, Klarna can assess whether you can make use of the payment options offered via Klarna and adapt the payment options to your needs. You can find general information about Klarna here. Your personal information will be treated by Klarna in accordance with the applicable data protection regulations and in accordance with the information in Klarna's data protection regulations.
 

 

6. Cookies & Reach measurement
Cookies are information transferred from our web server or third-party web servers to the web browsers of the users, and are there stored for later retrieval. Users are informed about the use of cookies for pseudonymous reach measurement within the scope of this privacy statement.
Viewing of this online offer is also possible with the exclusion of cookies. If users don’t want cookies to be stored on their computer, they are asked to deactivate the respective option in the system settings of their browser. Stored cookies can be deleted in the system settings of the browser. The exclusion of cookies, however, may result in functional restrictions of this online offer.

7. Google Analytics
We use Google Analytics, a web analysis service of Google Inc. (“Google”). Google uses cookies. Information about the usage of the online offer by the users generated by the cookie is normally transferred to a server of Google in the USA and stored there. Google uses this information on our behalf to analyse the usage of our online offer by the users, to compile reports about the activities within this online offer, and to render further services associated with the usage of this online offer and the internet usage for us. In that, pseudonymous usage profiles of the users may be generated from the data processed.

We only use Google Analytics with activated IP anonymisation. That means, the IP address of the users is only shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is transferred to a server of Google in the USA and shortened there.

The IP address transmitted by the browser of the user is not combined with other data of Google. Users can prevent the storage of cookies with a respective setting of their browser software; furthermore, users can prevent acquisition of the data generated by the cookie and related to their usage of the online offer and its transmission to Google as well as processing of this data by Google by downloading and installing the browser plugin available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

8. Google-re/marketing-services
We use the marketing and remarketing services (short “Google marketing services”) of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). The Google marketing services enable us to display advertisements for and on our website in a more targeted fashion, in order to only present advertisements to users, which potentially correspond with their interests. If users are, e.g., displayed advertisements for products, in which they were interested on other websites, then this is called “remarketing”. For this purpose, upon visiting our and other websites, on which Google marketing services are active, a code of Google is immediately executed by Google, and so-called (re)marketing tags (invisible graphics or code, also referred to as “web beacons”) are included into the website. Using them, an individual cookie, i.e. a small file, is stored on the device of the users (instead of cookies, comparable technologies may also be used). The cookies can be set by various domains, among others by google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com, or googleadservices.com. In this file it is noted, which websites the user visited, which contents he/she is interested in, and which offers he/she clicked on; furthermore included are technical information on browser and operating system, referring websites, visit duration and/or time, as well as other details of usage of the online offer. The IP address of the users is likewise acquired, wherein we inform within the scope of Google Analytics, that the IP address is shortened within member states of the European Union or in other contracting states of the Agreement on the European Economic Area, and only in exceptional cases it is transferred in its entirety to a server of Google in the USA and shortened there. The IP address is not combined with data of the user within other offers of Google. This information stated above may also be linked with such information from other sources. If the user subsequently visits other websites, matching advertisements according to his/her interests may be displayed to him/her. The data of users is pseudonymously processed within the scope of the Google marketing services. I.e., Google does not store and process, e.g., the name or E-mail address of users, but processes the relevant data in a cookie-related fashion within pseudonymous user profiles. I.e., from Google’s point of view, the advertisements are not managed and displayed for a concretely identified person, but for the cookie holder, independent of who this cookie holder is. This shall not apply, if a user has expressly allowed Google to process his/her data without this pseudonymisation. Information about the user collected by “DoubleClick” is transmitted to Google and stored on Google’s servers in the USA.

The Google marketing services we use include, among others, the online advertising programme “Google AdWords”. In case of Google AdWords, every AdWords customer receives a different “conversion cookie”. Thus, cookies cannot be tracked via the websites of AdWords customers. Information obtained using the cookie serves the generation of conversion statistics for AdWords customers, who decided in favour of conversion tracking. AdWords customers are informed about the total number of users, who clicked on their advertisement and were referred to a page provided with a conversion tracking tag. However, they do not receive any information, using which users can be personally identified.

On the basis of the Google marketing service “DoubleClick”, we integrate third-party advertisements. DoubleClick uses cookies, using which Google and their partner websites are enabled to display advertisements on the basis of visits of users on this website or other websites on the Internet, resp.

On the basis of the Google marketing service “AdSense”, we furthermore integrate third-party advertisements. AdSense uses cookies, using which Google and their partner websites are enabled to display advertisements on the basis of visits of users on this website or other websites on the Internet, resp.

A further Google marketing service we use is “Google Tag Manager”, using which further Google analysis and marketing services can be integrated into our website (e.g. “AdWords”, “DoubleClick”, or “Google Analytics”).

9.Facebook social plugins
Our online offer uses social plugins (“plugins”) of the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”). The plugins can be identified by one of the Facebook logos (white “f” on a blue tile, the term “Like” or a “thumbs up” symbol) or are marked with the addition “Facebook social plugin”. For the list and the appearance of the Facebook social plugins, see: https://developers.facebook.com/docs/plugins/. If a user selects a function of this online offer, which contains such a plugin, then his/her device establishes a direct connection with the servers of Facebook. The contents of the plugins is transmitted by Facebook directly to the device of the user and there integrated into the online offer. In that, usage profiles of the users may be generated from the data processed. Therefore, we have no influence on the scope of data Facebook collects using this plugin, and therefore inform the users according to our state of knowledge.

With the integration of plugins, Facebook receives the information that a user visited the respective page of the online offer. If the user is logged in with Facebook, Facebook can allocate the visit to his/her Facebook account. If users interact with the plugins, for example actuate the “Like” button or write a comment, then the respective information is directly transmitted from their device to Facebook and stored there. If a user is not a member of Facebook, there still is the possibility that Facebook acquires and stores his/her IP address. According to Facebook, in Germany, only an anonymised IP address is stored.

Purpose and scope of data collection and further processing and usage of the data by Facebook as well as the rights and setting options for the protection of the users’ privacy in this regard can be retrieved from the notes on data protection of Facebook: https://www.facebook.com/about/privacy/. If a user is a Facebook member and does not want Facebook to collect data about him/her via this online offer and to link it with his/her membership data stored with Facebook, then he/she must log off from Facebook prior to using our online offer and delete his/her cookies. 10. Facebook remarketing
Within our online offer, we use so-called “Facebook pixels” of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are resident in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, resp. (“Facebook”). Using the Facebook pixel, Facebook is enabled to determine the visitors of our offer as a target group for the presentation of advertisements, so-called “Facebook ads”. Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to such Facebook users, who actually showed an interest in our Internet offer. I.e., using the Facebook pixel, we want to ensure that our Facebook ads correspond to the potential interests of the users and have no annoying effect. Using the Facebook pixel, we can furthermore retrace the effectiveness of the Facebook advertisements for statistical and market research purposes, by seeing, whether users, after clicking on a Facebook advertisement, were referred to our website.

The Facebook pixel is immediately integrated by Facebook upon visiting our websites and can store a so-called cookie, i.e., a small file, on your device. When you subsequently log in with Facebook or visit our websites while being logged in with Facebook, the visit of our offer is noted in your profile. The data collected about you is anonymous for us, thus it does not offer any conclusion as to the identity of the users. However, the data is stored and processed by Facebook, so that a connection to the respective user profile is possible. Processing of the data by Facebook is undertaken within the scope of Facebook’s data usage policy. 11. Twitter buttons
We use the buttons of the Twitter service. These buttons are offered by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA. They can be recognised by terms like “Twitter” or “Follow” or in connection with a stylised blue bird. Using the buttons it is possible to share a contribution or website of this online offer on Twitter or to follow the provider on Twitter.
If a user visits a website of this online offer, which includes such a button, his/her browser establishes a direct connection with the servers of Twitter. The contents of the Twitter buttons is transmitted by Twitter directly to the browser of the user. Therefore, we have no influence on the scope of data Twitter collects using this plugin and inform the users according to our state of knowledge. According to that, only the IP address of the user as well as the URL of the respective website are transmitted upon clicking on the button, however, are not used for other purposes than the representation of the button. 12. Pinterest buttons
We use the buttons (“Pin It”) of the Pinterest service http://pinterest.com. Using the buttons, the users are enabled to share our products or websites on theirs “Pinterest boards”.

If a user visits a website, which contains a “Pin It” button, his/her browser establishes a direct connection with the servers of Pinterest. The contents of the “Pin It” button is transmitted by Pinterest directly to the browser of the user. Therefore, we have no influence on the scope of data Pinterest collects using the “Pin It” button and inform the users according to our state of knowledge. According to that, only the IP address of the user as well as the URL of the respective website are transmitted, however, are only used for the purposes of representation of the “Pin It” button and for sharing the contents.

13. Google+
We use the buttons of the social network Google+ (e.g. the “+1” button), which is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). If a user visits a website of this online offer, which contains such a button, the browser establishes a direct connection with the servers of Google. The contents of the buttons is transmitted by Google directly to his/her browser and there integrated into the website. Therefore, the provider has no influence on the scope of data Google collects with the buttons. According to Google, no personal data is collected without clicking on the button. Only for logged in members of Google+, such data, including the IP address, is collected and processed. 14. Newsletter
With the following notes, we inform you about the contents of our newsletter as well as the registration, mailing and statistical analysis methods as well as your rights of objection. By subscribing to our newsletter, you declare your consent to the receipt and the methods described. Contents of the newsletter: We send the newsletter, E-mails and further electronic notifications with promotional information (hereinafter “newsletter”) only with the consent of the recipients or a legal permission. If within the scope of a subscription to the newsletter, its contents is concretely described, then this is decisive for the consent of the users. Furthermore, our newsletters contain the following information: “events, our products, product offers, promotions, and general information about our company”. Double opt-in and logging: The registration for our newsletter is undertaken with a so-called double opt-in method. I.e., following registration, you receive an E-mail with the request to confirm your registration. This confirmation is necessary, so that registrations cannot be undertaken with an unknown E-mail address. Registrations for the newsletter are logged in order to be able to verify the registration process according to the legal requirements. This includes storing of the registration and confirmation times as well as the IP address. Changes to your data stored with the mailing service provider are likewise logged. Mailing service provider: Mailing of the newsletters is undertaken by “Eyeworks GmbH, Hauptstrasse 52, 8582 Rosental / Austria” (hereinafter referred to as “mailing service provider”). The data protection regulations of our mailing service provider can be retrieved from the website of Österreichische Post AG or the website of DPD-Austria, resp. The E-mail addresses of our newsletter recipients as well as their further data described within the scope of these notes are stored on the servers of the mailing service provider. The mailing service provider uses this information for mailing and analysing the newsletters on our account. Furthermore, the mailing service provider, according to their own information, may use this data to optimise or improve their own services, e.g. for technical optimisation of the mailing and the representation of the newsletters or for commercial purposes, in order to determine, in which countries the recipients reside. However, the mailing service provider does not use the data of our newsletter recipients to contact them themselves or does not pass them on to third parties. Registration data: In order to register for the newsletter, it is sufficient to state your E-mail address. As an option, we ask you to state the following data: “first and family name and address for the purpose of personalising the newsletter, date of birth and sex for the purpose of adapting the contents of the newsletter to the interests of our readers”. Statistical survey and analyses: The newsletters contain a so-called “web beacon”, i.e., a pixel-size file, which is retrieved from the server of the mailing service provider upon opening the newsletter. Within the scope of this retrieval, first, technical information, like information on your browser and system, as well as your IP address and the time of retrieval are collected. This information is used for technical improvement of the services on the basis of the technical data or the target groups and their reading behaviour on the basis of their retrieval locations (which can be determined using the IP address) or the access times. The statistical survey likewise includes the determination, whether the newsletters are opened, when they are opened, and which links are being clicked on. For technical reasons, this information may be allocated to the individual newsletter recipients. However, it is neither our intention nor that of the mailing service provider to observe individual users. We rather use the analyses to learn about the reading habits of our users and to adapt our contents to that or to mail different contents according to the interests of our users. Cancellation/Revocation: You may cancel the receipt of our newsletter anytime, i.e., revoke your consent. This simultaneously terminates your consent to its mailing by the mailing service provider and the statistical analyses. Unfortunately, revoking of the mailing by the mailing service provider or the statistical analysis separately is not possible. A link for the cancellation of the newsletter can be found at the end of each newsletter.

15. Product recommendation via E-mail
Should you have made a purchase from Eyeworks, then you will receive product recommendations via E-mail from us at regular intervals. You will receive these product recommendations from us independent of a subscription to our newsletter. In this manner, we would like to provide you with information about products from our offer, which you might be interested in on the basis of your last purchases from us. If you don’t wish to receive product recommendations or any promotional news from us at all, then you can object to this anytime, without other than the transmission costs according to the base rates arising for that. A written notification to the contact stated under Item 1 (e.g. E-mail, fax, letter) is sufficient for that. Of course there also is an unsubscribe link in every E-mail.

16. Usage of your data for advertising purposes
Beside processing of your data for handling of your purchase from Eyeworks, we will also use your data for the following purposes: to permanently improve your shopping experience and to provide a customer-friendly and individual design; to communicate with you about your orders as well as about certain products or marketing measures; and to recommend products or services you might be interested in. For that, we use information present, as for example receipt and reading confirmations of E-mails, information about the user equipment you use, your connection to the Internet, operating system and platform, date and time of your visit of the homepage, or products you viewed as well as information we received from you (including automatically transmitted or generated information). Besides that, we also use your purchasing history. You may object to the usage of your personal data for advertising purposes anytime as a whole or for individual measures, without other than the transmission costs according to the base rates arising for that. A written notification to the contact stated under Item 1 (e.g. E-mail, letter) is sufficient for that.

17. Competitions, market research, and opinion polling
In case of competitions, we will use your data for the purpose of prize notifications and advertisement for our offers. Detailed information on that will be included in the conditions of participation of the respective competition. We will furthermore use your data for market research and opinion polling. Data collected within the scope of market research and opinion polling will not be used for promotional purposes. Detailed information (in particular on the analysis of your details) will be included in the scope of the respective survey or where you provide your details, resp. Your answers in surveys will not be passed on to third parties or published. You may object to the usage of data for market research and opinion polling anytime as a whole or for certain measures, without other than the transmission costs according to the base rates arising for that. 18. Integration of services and third-party contents
It may be possible, that contents or services of third-party providers, as for example city maps or fonts of other websites, are integrated within our online offer. The integration of contents of the third-party providers always requires that the third-party providers obtain the IP address of the users, since without the IP address, they cannot send the contents to the browser of the users. Thus, the IP address is required for the representation of this contents. Furthermore, the providers of the third-party contents may set their own cookies and process the data of the users for their own purposes. In that, usage profiles of the users may be generated from the data processed. We will use this contents as data-economical and data-avoiding as possible as well as choose third-party providers reliable with regard to data security.

19. Rights of users and deletion of data
Users shall have the right to obtain, upon request, information about their personal data stored by us for free. In addition, users shall have the right to correction of incorrect data, withdrawal of consents, blocking and deletion of their personal data, as well as the right, in case of a suspicion of illegal data processing, to lodge a complaint with the competent supervisory authority.

The data we stored is deleted as soon as it is no longer required for its purpose and such deletion is not opposed by legal retention requirements.

20. Changes to the privacy statement
We reserve the right to change the privacy statement in order to adapt it to altered legal situations or in case of changes to the service as well as data processing. This, however, shall only apply with regard to declarations on data processing. If consents of the users are required or components of the privacy statement include regulations of the contractual relationship with the users, then such changes shall only be undertaken with the consent of the users. The users are requested to inform themselves about the contents of the privacy statement on a regular basis.
